Freeman Freeman & Smiley Litigation Team Achieves Favorable Settlement with Microsoft

A team of Freeman Freeman & Smiley litigation attorneys recently obtained a highly favorable settlement of a federal court lawsuit asserting copyright and trademark infringement claims brought by Microsoft against a firm client based on the use of allegedly counterfeit and unauthorized Windows licenses.

By adopting a proactive strategy designed to convince Microsoft to accept a modest settlement (principally funded by the client’s insurer) along with offers of cooperation in pursuing the entities that provided our client with the counterfeit licenses, a settlement was reached that allowed the client to prevail.

The retired federal magistrate judge who conducted the mediation which produced the settlement offered high praise for the firm’s litigation strategy, observing that it was so “out-of-the box” that it produced a settlement that “saved your client’s business.”
